General
1.1 These general terms and conditions apply to the Scratch & Win action organized by Agora Group, located at Keizershoek 312 in Kontich.
1.2 Participation in the Scratch & Win action implies acceptance of these game conditions.
1.3 Agora Group reserves the right to suspend, terminate or modify the Scratch & Win promotion at any time and not to pay out the prizes, without any possibility of compensation for the participants.
1.4 The Code of Conduct for Promotional Games of Chance 2014 applies to this Scratch & Win promotion.
Content Action
2.1 During the Agora Birthday Party, a scratch card will be distributed to all visitors upon receipt of their invoice. Scratch off tickets will only be given out on purchases made in our Cash & Carry, not valid on online purchases.
2.2 The Scratch & Win promotion runs from Monday, August 30, 2021 through Monday, September 6, 2021.
2.3 With every purchase made in our Cash & Carry during the Agora Birthday Party, the customer will receive a scratch card. Scratch cards are provided at the checkout upon payment of the invoice in our stores in Brussels, Kontich, Liege and Nivelles. For the scratch cards, gone = gone.
Prices
3.1 There are several prizes to be won, including 10 x a folding bike, and 25 x a Segway step, 600 x €5 voucher and 80 x €25 voucher.
3.2 To be eligible for a prize, the winner is required to present the winning scratch card to one of our employees. The code must be clearly legible.
3.3 Prizes are personal and not redeemable for any other prize or cash and can only be redeemed in Agora Group’s Cash & Carry.
Participation and participants
4.1 Participation is open to any natural person over the age of 18 residing in Europe. There are no costs involved in participating in this win action.
4.2 Agora Group has the right to exclude a participant from a Scratch & Win promotion if it appears that the participant has provided inaccurate, incomplete or misleading information or is otherwise committing or attempting to commit fraud.
4.3 In no event shall Agora Group be held responsible for the entry by the Participant of an incorrect telephone number, e-mail or home address, which leads to an incorrect or unknown address of the Participant, as well as any network, hardware or software malfunction that results in limited or delayed provision of data by the Participant, or loss of such data.
4.4 No gaming tax is applicable to this promotion.
4.5 By participating, each prize winner declares that he/she agrees to cooperate in any promotional activities related to the Scratch & Win promotion, including the presentation of the prize. Any photos may be used by Agora Group for publicity purposes. Furthermore, prize winners declare their agreement with the possible publication of a report/editorial article including photos on www.agoragroup.com.
Data
5.1 Participants agree to provide their name and address information for the purpose of order delivery.
5.2 Agora Group handles data with care and acts in accordance with laws and regulations in the field of personal data protection. Processing of this data will take place in accordance with Agora Group’s privacy statement.
Modification of game conditions and technical provisions
6.1 Agora Group will at all times be entitled, without prior notice, to change these conditions during the Scratch & Win Campaign and, without giving any reason, to discontinue or change the Scratch & Win Campaign, without Agora Group being liable in any way to pay compensation to participants for (any) losses. In the event of changes to these conditions, Agora Group will take the reasonable interests of the participants into account.
6.2 Agora Group does not guarantee the undisturbed and uninterrupted functioning of its website(s) or the services provided or used by it. Despite Agora Group’s utmost care in managing the website, it is possible that information is incomplete or incorrect. The participant is himself responsible for adequate facilities (such as telecommunication facilities) to participate in the Scratch & Win action.
Complaints
7.1 If a participant has a complaint or objection in connection with the Scratch & Win action organized by Agora Group, the participant may notify Agora Group within 5 working days after the complaint arose or could reasonably be determined, by sending a letter to Agora Group, Keizershoek 312 2550 Kontich, or an e-mail to agora@agoragroup.com stating ‘complaint Scratch & Win action’.
Liability
8.1 Agora Group is not liable for any damage, of whatever nature, resulting from or related to (participation in) the Scratch & Win Campaign. Printing, spelling, typesetting or similar errors cannot be held against Agora Group and cannot in any way create an obligation for Agora Group. Agora Group will not be liable for any damage of any kind in connection with the use of the website or other technical facilities. Agora Group is not responsible or liable for any costs incurred by the participant in connection with participation in the Scratch & Win Action.
Force Majeure
9.1 Agora Group reserves the right not to proceed to the payment of one or more prizes in case of force majeure. Force majeure is, in any case, understood to mean the declaration of bankruptcy of the supplier and/or sponsor of a prize or the application for suspension of payment by this supplier and/or sponsor or by Agora Group itself.
Applicable law
10.1 These terms and conditions of the game and the Scratch & Win Campaign are governed by Belgian law.
